On 21 November 2025<\/strong>, the Bundesrat<\/strong> (Federal Council) adopted the Sixth Ordinance Amending the Annex to the New Psychoactive Substances Act (NpSG)<\/a><\/strong>.<\/p>\n\n\n\n Following publication in the Federal Law Gazette<\/strong>, the ordinance entered into force on 02 December 2025<\/strong>.<\/p>\n\n\n\n As a result, 1S-LSD<\/strong> is now covered by the NpSG annex<\/strong>. The NpSG prohibits dealings with substances listed in its annex; in practice, enforcement and criminal liability are primarily aimed at conduct involving distribution<\/strong> (e.g., placing on the market \/ trading).<\/p>\n\n\n\n <\/p>\n\n\n\n On 13 May 2025<\/strong>, the BfArM expert committee convened and prepared a draft for the next amendment to the NpSG. It made one thing clear: 1S-LSD was intended to be banned<\/strong>.<\/p>\n\n\n\n In September<\/strong>, an unexpected twist followed: shortly before the Bundesrat session on 26 September 2025<\/strong>, a late proposal for a general ban<\/strong> was introduced, aimed at prohibiting all potential future derivatives.<\/p>\n\n\n\n However, in its counter-statement the Federal Government<\/strong><\/a> unexpectedly rejected the Bundesrat\u2019s proposal, citing the principle of legal certainty<\/strong> \u2014 meaning that laws must be drafted clearly and unambiguously.<\/p>\n\n\n\n Instead, it announced that 1S-LSD would be specifically added to the annex of the NpSG via a separate ordinance<\/strong>.
