Short update (as of October 2025)
26/09/2025: The Federal Council (Bundesrat) adopts a bill to amend the New Psychoactive Substances Act (NpSG) and suggests expanding the LSD-derivatives provision to prevent circumvention (e.g., 1S-LSD).
Federal Government’s counter-statement (01/10/2025): The Federal Government rejects this “broad” wording (German principle of legal certainty) and instead announces a parallel ordinance procedure intended to add, among others, 1-S-LSD to the annex of the NpSG.
17/10/2025: The NpSG amendment is currently not on the agenda of the Bundesrat session. The next possible date for a ban is the meeting on 21/11/2025. (The final agenda is published shortly beforehand; additions are possible.)
What happened recently
On 13 May 2025, the BfArM expert committee met and drafted a ministerial draft for the next NpSG amendment. It makes clear: 1S-LSD is to be banned.
In mid-September, documents for the 26/09/2025 Bundesrat session were then submitted at short notice. Many initially assumed a swift, comprehensive ban, including of 1S-LSD.
In its unexpected counter-statement, the Federal Government emphasized the principle of legal certainty enshrined in the Basic Law and rejected the Bundesrat’s proposal to word the LSD group very broadly; instead, it intends to use an ordinance to specifically add new substances (including 1-S-LSD) to the annex.
Will the 1S-LSD ban still happen?
Probably yes, but later: Since the Federal Government is opting for an ordinance, 1S-LSD can still be added — just not via the broad wording proposed by the Bundesrat. As the NpSG amendment is not on the agenda for 17/10, the earliest realistic date is the Bundesrat session on 21/11/2025 (with the usual lead time: publication and entry into force shortly thereafter). Note: Agenda additions are generally possible.
